Employee Benefits Liability covers omissions or errors in the administration of employee benefit plans.  For example, let’s say you don’t add a new employee to the benefit plan, and that employee suffers a claim (emergency surgery, etc.) If this employee has no insurance in effect, the employee benefits liability policy would cover the company for defense costs and the loss all the way up to the policy limit.

While some carriers write employee liability benefits coverage on an occurrence basis, others write it on a “claims made” basis. Employee Benefits Liability is conventionally added to the General Liability policy.
